Regarding the Joint Use of Merchant Information
Nuvei Payment Services Japan Co., Ltd. jointly uses merchant information in accordance with Article 23, Paragraph 5, Item 3 of the Act on the Protection of Personal Information, as described below.
1. About the Merchant Information Exchange System
The Japan Credit Association (the "Association") is certified by the Minister of Economy, Trade and Industry under the provisions of Article 35-18 of the Installment Sales Act.
The Association conducts the collection, organization, and provision of information necessary to protect the interests of users (credit users) as part of its certified functions through the Merchant Information Exchange Center (the "JDM Center").
2. Reporting and use of information collected from merchants
Member companies of the Merchant Information Exchange System ("JDM Members") collect and use the information specified in "3.(2) Details of information jointly used" for purposes such as merchant screening at the time of contract application, merchant review after contract conclusion, actions taken against merchants, and examinations related to continuation of transactions. This information is reported to the JDM Center and jointly used by JDM Members.
3. Joint use of merchant information
(1) Purpose of joint use
In the Merchant Information Exchange System operated as part of the certified functions prescribed under the Installment Sales Act, information concerning acts by merchants that lack sufficient protection of users (including suspected acts and acts for which determining applicability is difficult), information necessary for protecting users, information concerning acts by merchants that hinder the appropriate management of credit card numbers and the prevention of fraudulent use (hereinafter referred to as "appropriate management of credit card numbers"), and information necessary for appropriate management of credit card numbers is reported by our company to the JDM Center and jointly used by JDM Members. Through this reporting and joint use, the aim is to improve the accuracy of screening conducted by JDM Members at the time of merchant contract conclusion or during the contract period, eliminate malicious merchants, promote appropriate management of credit card numbers, and contribute to the sound development of credit transactions and the protection of consumers.
(2) Details of information jointly used
- Facts and reasons related to investigations necessary for handling complaints concerning individual credit purchase intermediation transactions involving the merchant
- Facts and reasons related to the termination of individual credit purchase intermediation contracts due to acts lacking user protection
- Facts and reasons related to investigations necessary to ensure appropriate management of credit card numbers under credit card number handling contracts
- Facts and reasons concerning measures taken when such measures do not meet, or may not meet, the standards prescribed in the Installment Sales Act for appropriate management of credit card numbers (including termination of credit card number handling contracts)
- Objective facts relating to acts that caused unfair damage to JDM Members or users in connection with acts deemed to lack user protection (including suspected or difficult-to-determine cases)
- Information reported by users (including those not under contract) and information determined to constitute acts lacking user protection (including suspected acts and cases where determining whether an act occurred is difficult)
- Information regarding acts by merchants that hinder appropriate management of credit card numbers
- Facts and content of matters published by administrative authorities (including information published concerning violations of the Act on Specified Commercial Transactions) as collected by the JDM Center
- Other information related to acts lacking user protection
- The merchant's name, address, telephone number, and date of birth (or, in the case of a corporation, corporate name, address, telephone number, corporate number, and the representative's name and date of birth). However, for item 6 where determining whether an act occurred is difficult, the name, address, telephone number, and date of birth (or representative's name and date of birth for corporations) are excluded.
(3) Retention period
The information listed above in (2) is retained for no longer than five years from the date of registration (or, for items 3 and 7, from the date of completion of the related measures in item 4 or from the date of contract termination registration).
4. Scope of joint users of merchant information
The jointly used merchant information is shared among comprehensive credit purchase intermediaries, individual credit purchase intermediaries, credit card number handling contract businesses, and the JDM Center, all of which are Association members and JDM Members.
